Where Rye Draws the Line

Rye has been a city since 1942, and its building rules are in Chapter 68 of the City Code. Section 68-8 is unusually specific about bathrooms. It lists bath modernization among the interior work that doesn’t need a building permit, but only if three things are true:

  • no structural changes and no changes to lighting, ventilation or building systems,
  • the plumbing isn’t moved, and
  • the replacement is done by a licensed plumber.

That table is a planning guide; the Building Department makes the call. We ask before we schedule.

Rye Bathrooms, Then and Now

Many Rye houses are older homes with original tile baths: small hexagon floors, pedestal sinks and a tub under the window. Owners usually want more storage, a larger shower and better ventilation. Near the Sound and Blind Brook, where parts of Rye are in FEMA flood zones, we also talk through materials for any bath at or below grade.

The Rye Forms We Handle

The City’s permits page lists separate Plumbing, Electrical and Mechanical permits, plus a Floodplain Management Permit and a Sewer Lateral Discharge Compliance Certificate. We tell you which ones your bathroom needs and file them. Guardian has remodeled homes since 1980 under Westchester County HIC #WC-38383-H24, with licensed, insured subcontractors for plumbing and electrical, supervised by a Guardian project manager. Rye Bathroom Remodeling FAQs

Can I update a bathroom in Rye without a building permit?

Sometimes. Section 68-8 of the Rye City Code exempts bath modernization that doesn’t involve structural changes or alter lighting, ventilation or systems, as long as the plumbing isn’t moved and replacement is done by a licensed plumber. Plumbing and electrical permits can still apply, and we confirm with the Building Department.

What makes a Rye bathroom need a permit?

Moving plumbing, changing structure, extending electrical, or changing ventilation. The Code also lists finishing a basement or cellar to add living space or a toilet, and finishing an attic, as work that needs a building permit.

Does a basement bathroom need anything else?

In Rye, a toilet in a finished basement is specifically listed as needing a building permit. In a FEMA flood zone, the City’s Floodplain Management Permit can apply as well. We check the flood map for your address first.

How do I reach the Building Department?

It’s at City Hall, 1051 Boston Post Road (914-967-5400), and takes digital submissions at building@ryeny.gov. We file for you and keep you copied.

What warranty comes with the bathroom?

A written one-year warranty on the work we do. Faucets, toilets, vanities and tile carry their makers’ warranties, which we hand over at the end.
